Terms of Service

Effective: 1 August 2025

Welcome to Attendwave, a product of Haqqman Agency. By accessing or using Attendwave (“the Service”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully. If you do not agree, you may not use the Service.

1. Acceptance of Terms

By creating an account, you confirm that you are at least 18 years old, have the legal authority to bind your organisation to these Terms, and agree to comply with them. These Terms constitute a binding agreement between you and Haqqman Agency.

2. Description of Service

Attendwave provides QR code-based employee attendance tracking. Managers can create entities, invite employees, generate location QR codes, and monitor attendance logs. The Service is provided on a subscription basis as described in our Pricing page.

3. Account Registration

You must register an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at hello@haqqman.com of any unauthorised use.

4. Subscription and Billing

The Service operates on a monthly billing cycle. Invoices are generated on the 1st of each month. The first invoice is prorated based on each employee's activation date. The first 2 active employees per entity are free; subsequent employees are billed at ₦500 per active employee per month, capped at ₦25,000 per entity per month. Prices are subject to change with 30 days' notice. We reserve the right to introduce Enterprise and annual plans in the future.

5. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorised access to any part of the Service; (c) upload malicious code or interfere with the Service's integrity; (d) resell or sublicense the Service without written permission; (e) use the Service to track individuals without their knowledge or consent.

6. Intellectual Property

All intellectual property in the Service — including the software, design, trademarks, and content — is owned by or licensed to Haqqman Agency. These Terms do not grant you any rights in our intellectual property except the limited right to use the Service as permitted.

7. Employee Data

You are responsible for obtaining appropriate consent from employees before using the Service to track their attendance. You act as the data controller for your employees' personal data. We process that data on your behalf as a data processor, subject to our Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Haqqman Agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.

9. Termination

You may close your account at any time. We may suspend or terminate your access for breach of these Terms, non-payment, or at our discretion with 14 days' notice. Upon termination, your data will be retained for 30 days then deleted, unless we are required to retain it by law.

10. Modifications

We may update these Terms from time to time. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in the courts of Lagos State, Nigeria.
